Game Rules

Game Rules of the “WIN A WILL’S SMART NUTRITION PACKAGE!” prize draw running on the following Instagram pages:
https://www.instagram.com/wills_smart_nutrition_hu/ and https://www.instagram.com/wabbahungary/

Organizer of the Promotion:
Will’s Nutrition Kft. (registered office: 5500 Gyomaendrőd, Ipartelep hrsz 3741/35.)
Certain administrative tasks related to the execution of the promotion are carried out by the agency appointed by the Organizer, NextNine Kft. (1151 Budapest, Bem utca 1., hereinafter: the “Administrator”).

Duration of the Game:
The game starts on October 29, 2025, at 08:00 (CET) and ends on November 19, 2025, at 23:59 (CET) on the @wills_smart_nutrition_hu and @wabbahungary Instagram page.

Participants:
The promotion is open to all natural persons over the age of 18 who are legally competent and have a permanent residence in Hungary during the promotional period.

1. Conditions of Participation / Entry

1.1. No purchase is required to participate; however, internet access and a valid Instagram account are necessary.
1.2. Participation is open to any natural person aged 18 or over who has a permanent residence in Hungary during the promotion period.
1.3. Employees of the Organizer and the Administrator, the Organizer’s parent company, subsidiaries, affiliated companies, or any parties involved in the development, creation, or distribution of the promotion, as well as their close relatives (spouse, parents, siblings, children) and household members, are not eligible to participate.
1.4. Entries submitted through third parties or agencies will be considered invalid.

2. The Promotion

2.1. One (1) winner will be selected by drawing lots from among the participants. One (1) substitute winner will also be drawn.
2.2. Prize:

·       900 g WILL’s Whey Protein or Vegan Protein Blend (flavor of choice)

·       450 g WILL’s Collagen (flavor of choice)

·       450 g WILL’s Pre-Workout Formula (flavor of choice)

·       one shaker

·       one canvas bag
2.3. To enter, participants must follow the @wills_smart_nutrition_hu Instagram page, like the giveaway post, and tag two friends who have valid Instagram accounts.
2.4. The winner will be selected by random draw on November 20, 2025, at 10:00 (CET). The Organizer’s decision regarding the prize and the winner is final.
2.5. The winner will be notified via the Instagram account used for entry within 24 hours of selection and will also be announced in a comment under the giveaway post. The winner must claim the prize within 5 days of notification. If the prize is not claimed within this period, it will be forfeited, and the Organizer reserves the right to offer the unclaimed prize to the substitute winner in accordance with these Terms.
2.6. During the process, one (1) substitute winner will be drawn.
2.7. The prize must be collected within 30 days from the date of the announcement.
2.8. The prize is non-transferable and cannot be exchanged for cash.
2.9. The Organizer reserves the right to verify all participants and, at its discretion, to disqualify any entrant who does not meet the eligibility requirements.
2.10. In unforeseen circumstances, the Organizer reserves the right (a) to replace the prize with one of equal or greater value and/or (b) in exceptional cases, to modify or terminate the promotion without prior notice. No correspondence will be entered into regarding this matter.
2.11. Entries must not contain any material that infringes the rights of others, including but not limited to privacy, publicity, or intellectual property rights, or that constitutes copyright infringement.
2.12. Entries must not include brand names or trademarks other than those of the Organizer.
2.13. Entries must not contain inappropriate, indecent, obscene, violent, hateful, torturous, abusive, defamatory, or libelous material.
2.14. Entries must not contain material that promotes fanaticism, racism, hatred, or harm against groups or individuals, or that contributes to discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age.
2.15. Entries must not contain material that is unlawful, violates, or is contrary to any laws or regulations in force at the time of submission.

3. Drawing Procedure

One (1) winner and one (1) substitute winner will be selected by drawing software on November 20, 2025, at 10:00 (CET). The drawing will be conducted using Simpliers software (https://simpliers.com/), which randomly selects the winner from participants who meet the game rules. The process is automatic and certified, ensuring the transparency of the prize draw.
The winner will be notified by the Organizer via private message no later than 19:00 (CET) on the day of the draw.

4. Obligations / Liabilities

4.1. Entrants shall have no legal claim against the Organizer in connection with their entry, except where their entry infringes any person’s personal or property rights.
4.2. Each entrant confirms that any person appearing in the entry has granted permission for their name and/or Instagram account to appear on any Will’s Smart Nutrition social media channel or platform.
4.3. The Organizer will use all data provided by entrants solely for the purposes of the promotion unless otherwise agreed. By participating, all entrants consent to the Organizer using their personal data for administrative purposes, including publishing their name and/or Instagram account together with other entrants if they win, or for any other purpose agreed with the entrant.
4.4. If the prize is subject to tax, all related taxes shall be borne by the Organizer.
4.5. This promotion is in no way sponsored, endorsed, or administered by Instagram. Entrants acknowledge that any and all information provided is submitted to the Organizer and not to Instagram, and agree that Instagram shall bear no liability whatsoever in connection with this promotion.
4.6. The winner agrees to participate in post-promotion publicity and consents to the public use of their name.
4.7. These Terms and Conditions are governed by the laws of Hungary.
4.8. Will’s Nutrition Kft. reserves the right to cancel or suspend the competition and amend these Terms without prior notice in the event of disaster, war, civil or military unrest, natural disasters, or the actual or foreseeable breach of any applicable law or regulation, or any event beyond the control of Will’s Nutrition Kft. Will’s Nutrition Kft. will notify entrants of any other changes to the competition as soon as possible via Instagram.
4.9. By participating in the promotion, entrants agree to be bound by these Terms and Conditions.

5. Data Processing

For data processing related to the Prize Draw, the Organizer (Will’s Nutrition Kft.) acts as the data controller. Data processing related to the Prize Draw is carried out in accordance with applicable legislation and the provisions of this policy. Personal data provided during the Prize Draw are processed solely for the purposes defined herein.

Data processing related to the administration of the Prize Draw

NextNine Kft., under a written agreement with the Controller, assists in administering the Prize Draw. In doing so, NextNine Kft. may process the names, email addresses, and postal addresses of invitees for up to 30 days following the sending of the last message, after which such data will be deleted without delay.

Purpose of data processing:
Registration of participation in the Prize Draw and administration of the Prize Draw.

Legal basis for processing:
Participants’ consent pursuant to Article 6(1)(a) of the General Data Protection Regulation (GDPR). Consent may be withdrawn at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

Personal data processed during entry:

·       Instagram username (nickname)

·       Instagram profile URL

Personal data processed in case of winning:

·       Name

·       Email address

·       Phone number

Duration of processing:
If consent is withdrawn, personal data will be deleted (and participation in the Prize Draw will automatically terminate upon deletion of the registration). Personal data will be deleted within 1 month after the end of the Prize Draw. In the case of winners, personal data will be stored until the end of the 8th year following the draw.

Participants acknowledge and accept the purpose of data processing. The Organizer will not transfer participants’ personal data to any additional third parties. The Organizer undertakes to ensure compliance with applicable legal provisions regarding the personal data of participants.

Data security:
The Organizer protects participants’ personal data with appropriate measures, particularly against unauthorized access, alteration, transmission, disclosure, deletion, or destruction, as well as accidental destruction or damage, and against inaccessibility resulting from changes in applied technology. The Organizer aims to ensure the highest possible level of protection of participants’ personal data and shall take all protective measures proportionate to the level of protection sought and the costs/resources required.

Rights related to data processing:
Participants may withdraw their consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent prior to its withdrawal. Participants may request from the Organizer:
a) information regarding the processing of their personal data;
b) rectification of their personal data; and
c) deletion or restriction of processing of their personal data (except in cases of mandatory processing).

Participants are entitled to receive confirmation from the Organizer as to whether their personal data are being processed and, where that is the case, to access the personal data. If information is refused, the Organizer shall inform the participant in writing of the legal basis for the refusal and of the possibilities of judicial remedy and of turning to the Authority. Upon request, the Organizer shall rectify inaccurate personal data concerning the participant without undue delay.

The Organizer shall delete the participant’s personal data without undue delay upon request where:
a) the processing of personal data is unlawful;
b) the participant requests deletion (in view of consent withdrawal);
c) the data are incomplete or inaccurate and this state cannot be lawfully remedied, provided that deletion is not precluded by law;
d) the purpose of processing has ceased to exist, or the statutory period for data retention has expired;
e) deletion has been ordered by a court or the National Authority for Data Protection and Freedom of Information.

The Organizer shall inform the data subject of measures taken upon their request without undue delay, but no later than 25 days from receipt of the request. If the participant submitted the request electronically, the information shall be provided electronically where possible, unless the participant requests otherwise. The Organizer shall provide information, access, and other measures to the participant free of charge. If the Organizer has reasonable doubts as to the identity of the natural person submitting the request, it may request additional information necessary to confirm the participant’s identity.
If the participant’s personal data are deleted at their request, their participation in the Prize Draw will automatically terminate.

Right to lodge a complaint and legal remedies:

In case of infringement of their rights, participants may bring an action against the Controller before a court. Proceedings shall be conducted as a matter of priority. The Controller bears the burden of proof to demonstrate compliance with the law. The case falls under the jurisdiction of the competent Törvényszék (County Court), and in Budapest under the competence of the Fővárosi Törvényszék (Budapest Metropolitan Court). The action may also be brought before the court of the participant’s place of residence or domicile. The Organizer shall compensate any damage caused to others by the unlawful processing of participants’ data or by the breach of data security requirements. The Controller shall be exempt from liability if it proves that the damage was caused by an unavoidable external cause falling outside the scope of data processing. No compensation shall be due to the extent that the damage arose from the participant’s intentional or grossly negligent conduct.
