Game Rules

Game Rules of the “WIN A WILL’S SMART NUTRITION PACKAGE!” prize draw running on the following Facebook pages:
https://www.facebook.com/WILLSSmartNutritionHU and https://www.facebook.com/wabbahungary

Organizer of the Promotion:
Will’s Nutrition Kft. (registered office: 5500 Gyomaendrőd, Ipartelep hrsz 3741/35.)
Certain administrative tasks related to the execution of the promotion are carried out by the agency appointed by the Organizer, NextNine Kft. (1151 Budapest, Bem utca 1., hereinafter: the “Administrator”).

Duration of the Game:
The game starts on October 29, 2025, at 08:00 (CET) and ends on November 19, 2025, at 23:59 (CET) on the @WILLSSmartNutritionHU and @wabbahungary Facebook page.

Participants:
The promotion is open to all natural persons over the age of 18 who are legally competent and have a permanent residence in Hungary during the promotional period.

1. Conditions of Participation / Entry

1.1. No purchase is required to participate; however, internet access and a valid Facebook account are necessary.
1.2. Participation is open to any natural person aged 18 or over residing in Hungary during the promotion period.
1.3. Employees of the Organizer and the Administrator, the Organizer’s parent company, subsidiaries, affiliated companies, or any parties involved in the development, creation, or distribution of the promotion, as well as their close relatives (spouse, parents, siblings, children) and household members, are not eligible to participate.
1.4. Entries submitted through third parties or agencies will be considered invalid.

2. The Promotion

2.1. One winner will be selected by drawing lots. One substitute winner will also be drawn.
2.2. Prize:

·       900 g WILL’s Whey Protein or Vegan Protein Blend (flavor of choice)

·       450 g WILL’s Collagen (flavor of choice)

·       450 g WILL’s Pre-Workout Formula (flavor of choice)

·       one shaker

·       one canvas bag

2.3. To enter, participants must follow the @WILLSSmartNutritionHU Facebook page, like the giveaway post, and tag two friends with valid Instagram accounts.
2.4. The winner will be selected by random draw on November 20, 2025, at 10:00 (CET). The Organizer’s decision regarding the prize and the winner is final.
2.5. The winner will be notified via their Facebook account within 24 hours of selection and announced in a comment under the giveaway post. The winner must claim the prize within 5 days of notification. If not claimed within this period, the prize will be forfeited, and the Organizer reserves the right to offer it to the substitute winner in accordance with these Terms.
2.6. Two substitute winners will be drawn during the process.
2.7. The prize must be collected within 30 days from the date of announcement.
2.8. The prize is non-transferable and cannot be exchanged for cash.
2.9. The Organizer reserves the right to verify all participants and to disqualify, at its discretion, any entrant who does not meet the eligibility requirements.
2.10. In unforeseen circumstances, the Organizer reserves the right (a) to replace the prize with one of equal or greater value and/or (b) to modify or terminate the promotion without prior notice. No correspondence will be entered into regarding this matter.
2.11. Entries must not contain material that infringes upon the rights of others, including but not limited to privacy, publicity, or intellectual property rights.
2.12. Entries must not include brand names or trademarks other than those of the Organizer.
2.13. Entries must not contain inappropriate, indecent, obscene, violent, hateful, torturous, defamatory, or libelous material.
2.14. Entries must not contain material promoting fanaticism, racism, hatred, or discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age.
2.15. Entries must not contain material that is unlawful or in violation of any laws or regulations in force at the time of submission.

3. Drawing Procedure

The winner and one substitute winner will be selected by random draw on November 20, 2025, at 10:00 (CET) using the Simpliers software (https://simpliers.com/), which randomly selects the winner from eligible participants.
The process is automatic and certified, ensuring the transparency of the prize draw.
The winner will be notified by the Organizer via private message no later than 19:00 (CET) on the same day.

4. Obligations / Liabilities

4.1. Entrants shall have no legal claim against the Organizer in connection with their participation, except if their entry infringes upon the rights of another individual.
4.2. Each entrant confirms that any person appearing in their entry has granted permission for their name and/or Facebook account to appear on any Will’s Smart Nutrition social media channel or platform.
4.3. The Organizer will use all personal data provided by participants solely for the purposes of the promotion unless otherwise agreed. By entering, participants consent to their personal data being used for administrative purposes and, if they win, to have their name and/or Facebook account published.
4.4. Should the prize be subject to taxation, all related taxes shall be borne by the Organizer.
4.5. This promotion is in no way sponsored, endorsed, or administered by Facebook. Participants acknowledge that any information provided is submitted to the Organizer and not to Facebook, and agree that Facebook shall bear no liability in connection with this promotion.
4.6. The winner agrees to participate in post-promotion publicity and consents to the public use of their name.
4.7. These Terms and Conditions are governed by the laws of Hungary.
4.8. Will’s Nutrition Kft. reserves the right to cancel or suspend the competition and amend these Terms without prior notice in the event of a natural disaster, war, civil unrest, or any other event beyond its control. In such cases, participants will be notified as soon as possible via Facebook.
4.9. By participating in the promotion, entrants agree to be bound by these Terms and Conditions.

5. Data Processing

The Organizer (Will’s Nutrition Kft.) is the data controller regarding all data processing related to the Promotion.
Data processing is carried out in accordance with applicable laws and the provisions of this policy. Personal data provided during the Promotion will be processed exclusively for the purposes described herein.

NextNine Kft. assists in the administration of the Promotion under a written agreement with the Organizer. The data processor may handle names, email addresses, and postal addresses of invitees for up to 30 days after the last communication, after which the data will be deleted.

5.2. Purpose of Data Processing:

Registration for participation and administration of the Promotion.

5.3. Legal Basis:

Participants’ consent pursuant to Article 6(1)(a) of the General Data Protection Regulation (GDPR).
Consent may be withdrawn at any time without affecting the lawfulness of processing based on consent before its withdrawal.

5.4. Personal Data Processed During Entry:

·       Facebook profile link

5.5. Personal Data Processed in Case of Winning:

·       Name

·       Email address

·       Phone number

5.6. Duration of Data Retention:

If consent is withdrawn, personal data will be deleted (and participation in the Promotion will automatically terminate).
Personal data will be deleted within 1 month after the Promotion ends.
In the case of winners, data will be stored until the end of the 8th year following the draw.

Participants acknowledge and accept the purpose of data processing. Personal data will not be transferred to third parties. The Organizer undertakes to handle all personal data in compliance with applicable legal requirements and to maintain appropriate data security measures.

5.7. Data Security:

The Organizer shall protect participants’ personal data against unauthorized access, alteration, transmission, disclosure, deletion, destruction, accidental loss, or damage, and against any change in technology that could make the data inaccessible. All security measures are applied proportionally to ensure the highest level of data protection.

5.8. Rights of Participants:

Participants may, at any time:
a) request information about the processing of their personal data;
b) request the rectification of their personal data;
c) request the deletion or restriction of processing (except in cases of mandatory data processing).

If the Organizer has reasonable doubts regarding the identity of the applicant, additional information may be requested to confirm identity.
If personal data are deleted at the participant’s request, their participation in the Promotion will automatically terminate.

5.9. Right to Lodge a Complaint and Legal Remedies:

Participants may also bring a claim before a competent court (in Budapest, the Metropolitan Court).
The Organizer is liable for damages resulting from unlawful data processing unless it proves that the damage was caused by an unavoidable external event. No compensation shall be due if the damage was caused intentionally or by gross negligence of the participant.
